BEARES PUBLISHING.COM TERMS AND CONDITIONS

 

Beares Publishing Limited and its subsidiaries and affiliates (collectively, "Beares Publishing") provide access to BearesPublishing.com and other websites operated by Beares Publishing (collectively, "Beares Publishing Websites") subject to these Terms and Conditions ("Terms"). By shopping at or visiting Beares Publishing Websites, you agree to these Terms and our Websites Privacy Policy. Please read them carefully. If you do not agree to these Terms please do not register or otherwise use Beares Publishing Websites.

The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects;

PURCHASE OF PRODUCTS FROM BEARES PUBLISHING WEBSITES

 

No contract will subsist between you and Beares Publishing for the sale by it to you of any product unless and until Beares Publishing actually dispatches the good to you. At any point up until then, we may decline to supply the goods to you without giving any reason. Beares Publishing is entitled to withdraw from any contract in the case of errors or inaccuracies regarding the goods or the order appearing on Beares Publishing Websites.


PRICING

Whilst Beares Publishing will make reasonable efforts to ensure that prices on Beares Publishing Websites are accurate, it will not be responsible for any errors that may occur. If Beares Publishing discover any errors in the price of goods, Beares Publishing will notify you as soon as possible and give you the option to resubmit your order at the correct price or cancel the order.

 

All prices are expressed as exclusive of any VAT or other sales tax payable unless otherwise stated.

 

There shall be an additional charge for delivery, the amount of which shall vary according to the delivery method that you choose.

 

Prices and delivery charges are subject to change without notice.

 

Authority for payment must be given at the time of placing your order.


AVAILABILITY

 

All orders are subject to availability, and Beares Publishing cannot guarantee the availability of any specific products.

 

In the event that Beares Publishing discovers that goods are unavailable after an order has been placed, Beares Publishing shall send you a notification by email giving you the option to modify or cancel the order.


DELIVERY OF GOODS AND RISK OF LOSS

 

Beares Publishing shall deliver the goods ordered to the main entrance at the delivery address, which you supply. All delivery times quoted on Beares Publishing Websites are estimates only based on availability, normal processing and delivery time.

All items purchased from Beares Publishing are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.


GUARANTEE, CANCELLATION AND RETURNS POLICY

 

If for any reason you are unhappy with the goods received, you can return them to Beares Publishing for an exchange or refund, providing each is returned to Beares Publishing’s returns processing centre in new condition within 14 days from the date of delivery. Except in cases of faulty, damaged or wrongly supplied goods you shall be responsible for the cost of returning goods for refund or exchange, and we will not refund the delivery charge for sending the item to you.

 

Beares Publishing recommends that you use registered post or recorded delivery and secure packaging when returning goods. Beares Publishing shall use reasonable efforts to replace damaged or defective goods but if replacement is not possible, Beares Publishing’s only obligation is to refund the amount paid by you. This does not affect your statutory rights.

 

The forgoing notwithstanding, Beares Publishing Collectors Editions are sold on a non-returnable basis and may not be returned unless received in damaged condition, unless otherwise required by law.


LICENSE AND SITE ACCESS

 

Beares Publishing grants you a limited license to access and make personal use of Beares Publishing Websites and not to download (other than page caching) or modify them, or any portion of them, except with express written consent of Beares Publishing. This license does not include any resale or commercial use of Beares Publishing Websites or their contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Beares Publishing Websites or their contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

INDEMNITY

 

You agree to defend, indemnify and hold Beares Publishing and any affiliated company or individual harmless from any and all liabilities, costs and expenses, including reasonable attorneys’ fees, related to any violation of these Terms by you or your authorized users, or in connection with the use of the Beares Publishing Websites or the Internet or the placement or transmission of any message or information on the Beares Publishing Websites by you or your authorized users. Beares Publishing shall provide notice to you promptly of any such claim, suit or proceeding and shall reasonably cooperate with you, at your expense, in your defense of any such claim, suit or proceeding.


TERMINATION OF USAGE

 

Beares Publishing reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion at any time.


TERMINATION OF AGREEMENT

 

This agreement may be terminated by Beares Publishing at any time without notice. In the event of termination, you will no longer be authorized to have access to the Beares Publishing Websites, and all limitations on Beares Publishing’s liability and on your use of Beares Publishing material shall survive.


ENTIRE AGREEMENT / SEVERABILITY

 

These Terms, along with any additional rules or conditions referred to herein, constitute the entire agreement and understanding between you and Beares Publishing as to your use of the Beares Publishing Websites, superseding all prior or contemporaneous communications and/or proposals. These Terms are severable, and in the event any provision is determined to be invalid or unenforceable, such invalidity or unenforceability shall not in any way affect the validity or enforceability of the remaining provisions. How long do we keep your personal details?

Data is held by us for as long as is legally or practically necessary for our business. Once that period of necessity has passed, we have a regular programme of data suppression and deletion. This ensures that your data is not held indefinitely on our systems.

Subject to any legal retention requirements (e.g. VAT regulations require appropriate financial records to be retained for six years, Gift Aid regulations require appropriate records to be retained for seven years), you may notify BEARES PUBLISHING if you do not wish your data to be held.
